Abstract
The problematic nature of the Universal Declaration of Human Rights (UN, 1948) has at least three dimensions: Universality, Juridicity and (Trans/Post)Humanity. The subject of the present study focuses on the contested juridical nature of human rights. From the initial confrontation between Axiology –or Morality– and Juridicity, the relevance of the Juridicity of Human Rights is underlined. Next, three hypotheses about the foundation of human rights are presented: the axiological, the juridicist and the legal-realist hypotheses. These three hypotheses correlate with the three sensibilities represented by the –isms of Law: Iusnaturalism, Iuspositivism and Iusrealism, respectively. The debate on the foundations of Human Rights is a sign of responsibility and commitment and is called to revolt against the prevailing indifference. Law as a manifestation of culture and the personal attitude are revealed as constitutive elements of the worldview that intends to enter into the controversial foundation of Human Rights.
Keywords: Human Rights, morality, juridicity, realistic attitude, scepticism.
