Resumen
O presente artigo apresenta (i) o percurso histórico de constru- ção do direito à cidade com a identificação de momentos e atores chave; (ii) a maneira como esse direito coletivo dos habitantes das cidades foi incluído na Nova Agenda Urbana aprovada na Conferência HABITAT III em Quito/2016 e, finalmente, (iii) uma análise da provável repercussão, no âmbito do Direito Interno dos países latino americanos, da assunção do direito à cidade em um documento de Direito Internacional. Utilizando-se do método de análise hipotético dedutivo e do método histórico de procedimento, a pesquisa realizada conclui que os componentes historicamente construídos do direito à cidade encontram-se presentes na Nova Agenda Urbana e exigem adaptações nos ordenamentos jurídicos dos países latinoamericanos, tanto no âmbito do Direito Público quanto no Direito Privado, inclusive nos Códigos Civis, já que o direito à cidade, como direito humano, exige um novo olhar, tanto para as leis de política urbana, como para institutos como o direito de propriedade, acarretando efeitos jurídicos concretos para o princípio da função social da terra.

Abstract
This article presents (i) the historical background of the construction of the right to the city with the identification of key moments and players; (ii) the manner in which this collective right of the inhabitants of the cities was included in the New Urban Agenda approved at the HABITAT III Conference in Quito/2016 and , finally, (iii) an analysis of the probable repercussion, within the context of the Internal Law of the Latin American countries, of the assumption of the right to the city in a document of International Law. Using the method of hypothetical deductive analysis and the historical procedure method, the performed research concluded that the historically constructed components of the right to the city are present in the New Urban Agenda and require adaptations in the legal systems of the Latin American countries, both in the context of Public and Private Law, and in the Civil Codes, since the right to the city, as a human right, requires a new perspective with respect to the urban policy laws, as well as to institutions such as the right of property, resulting in specific legal effects for the principle of the social function of the land.
