Resumen

La Nueva Constitución Política del Estado vigente desde febrero de 2009, reconoce la existencia de la Jurisdicción Indígena Originario Campesina (JIOC) en pie de igualdad con la Ordinaria y la Agroambiental. La emergencia de lo indígena, en Bolivia y en el nuevo texto constitucional, fue producto de siglos de lucha y pareció encontrar su rumbo con el ascenso del MAS al poder en 2006. Sin embargo la Ley de Deslinde Jurisdiccional de diciembre de 2010, echa por tierra a la JIOC, reduciéndola a su mínima expresión, incluso por debajo del proyecto de compatibilización entre la “jurisdicción ordinaria” y la “justicia comunitaria” de 1999.

Abstract

The New Political Constitution of the in force State from February, 2009, admits the existence of the Indigenous Jurisdiction Original Peasant (JIOC) in foot of equality with the Ordinary one and the Agroambiental. The emergency of the indigenous thing, in Bolivia and in the new constitutional text, was a product of centuries of fight and seemed to find his course with the ascent of MORE to the power in 2006. Nevertheless the Law of Jurisdictional Demarcation of December, 2010, he throws for land the JIOC, reducing it to his simplest form, even below the project of to making compatible between the “ordinary jurisdiction” and the “community justice” of 1999.
