Resumen

La implementación del Sistema Penal Acusatorio en México establece un nuevo paradigma relacionado con la privación de la libertad personal. La idea es la de protegerla y no restringirla hasta que se autorice en sentencia firme de condena. En este nuevo sistema, la libertad personal del imputado se protege al máximo, constituyéndose la regla general de enfrentar el procedimiento en libertad, y solo en casos mínimos podrá ser detenido. Este trabajo muestra que esos casos son los supuestos de flagrancia, urgencia y orden de aprehensión, para presentación inmediata ante un Juez, y cuando se solicite medida cautelar de prisión preventiva, siempre y cuando se demuestre la ineficacia de otras medidas menos lesivas.

Abstract

The new criminal justice system in Mexico creates a new paradigm concerning the deprivation of freedom and human rights. It is intended to prevent unlawful detentions unless and until an individual has been found guilty or the judge has pronounced a sentence for having committed a crime. Under this new system, individuals are innocent until proven guilty, and except in few circumstances, legal procedures serve to protect the accused and limit the government’s authority to restrict his/her freedom. The exceptions under which an accused can be taken into custody involve his/her apprehension during the commission of a crime, an emergency, the issuance of a warrant by a judge for an arrest, or as a precautionary measure requested by the State when other measures are not effective.
