A regulação da água no direito europeu e sua interface com o direito humano à água

Resumen

Em face do sólido arcabouço normativo no âmbito da União Europeia acerca da governança de recursos hídricos, busca-se analisar se os instrumentos normativos comunitários se coadunam com o direito humano à água, conforme delimitado por convenções internacionais e pela jurisprudência de tribunais internacionais. Assim, são apresentados o desenvolvimento e a construção jurídica do direito humano à água no ordenamento jurídico internacional, especificando seus fatores de adequabilidade e obrigações essenciais, para então analisar, à luz desses elementos normativos, as eventuais convergências ou divergências com as diretivas adotadas sobre recursos hídricos no contexto da legislação ordinária da União Europeia. Conclui-se que, apesar de não reconhecido expressamente, o direito humano à água é tutelado de forma reflexa pelo ordenamento comunitário, sendo este um arcabouço importante para a universalização desse direito. Verifica-se, também, que as experiências de regulação europeia acerca dessa matéria poderiam potencializar a implementação desse direito no âmbito do Mercosul, enquanto o ordenamento europeu poderia se beneficiar do reconhecimento do direito humano à água nos moldes da construção jurídica elaborada pela Corte Interamericana de Direitos Humanos. Esse diálogo inter-regional e interinstitucional poderia se demonstrar essencial para a difícil missão de universalizar o direito humano à água a nível mundial.

Abstract

In light of the solid normative framework within the European Union regarding water resources governance, the aim of this paper is to analyze whether European Union Law is consistent with the human right to water, as it is enshrined in international conventions and by the jurisprudence of international courts. This paper presents the development and legal construction of the human right to water in the international legal system, specifying its adequacy factors and essential obligations. Then, the paper analyzes, in light of these normative elements, the eventual convergence or divergence with the directives adopted on water resources in the context of the ordinary legislation of the European Union. It is concluded that, although not explicitly recognized, the human right to water is protected in a reflexive way by European Union Law, which is an important framework for the universalization of this right. It is also noted that the experiences of European regulation on this matter could enhance the implementation of this right within Mercosur, while the European framework could benefit from the recognition of the human right to water along the legal construction elaborated by the Inter-American Court of Human Rights. This interregional and inter-institutional dialogue could prove essential for the difficult mission of universalizing the human right to water worldwide.
