Resumen

Se realiza una reflexión en torno a los conflictos agrarios motivados por la lucha por la reforma agraria en Brasil. El eje central es entender cómo el Poder Judicial actúa ante los casos de “justicia dramática”, es decir, cuando están en juego demandas que reflejan problemas sociales graves, de los que son víctimas ciertos colectivos empobrecidos de la población, por ejemplo, de los sin tierra. Las ocupaciones de tierras improductivas se producen para forzar al poder público a cumplir con su obligación constitucional de hacer la reforma agraria. En efecto, jueces y magistrados accionados por demandas de naturaleza penal y civil: o se deciden a favor de los campesinos o de los latifundistas. Optar por los primeros significa alejarse del formalismo legal, reconocer y tener en cuenta, a la hora de juzgar, el carácter social del conflicto y poner en un primer plano el principio de la función social de la propiedad. Elegir a los segundos significa aferrarse a todo lo contrario.

Abstract

The paper presents an analysis of conflicts in context of the struggle for Agrarian Reform in Brazil. The center of the discussion focuses on how the Judicial Branch acts in response to cases of “dramatic justice”, when the plaintiffs present to the court serious social problems suffered by impoverished collectives such as los sin tierra (the landless, a wide social movement of the Brazilian rural areas). Landless peasants occupy unproductive estates to push the government to enforce the constitutional and legal statutes ordering Agrarian Reform. Faced with this kind of cases, the Civil or Criminal judges must decide in favor of either the peasants or the abusive landlords. However, to rule in favor of the former imply to abandon excessive legal formalism, to recognize and to take into account the social character of the issues presented to the court. This implies, also, to apply in concrete cases the abstract idea of the social function of private property. To rule in favor of the later implies to maintain traditional formality and a legal conception detached from social realities, where the abstracts principles which theoretically justify the Law are never actualized in real cases.
